Abstract

The COVID-19 pandemic has exalted the protagonism of the Italian Regions; however, the loyal cooperation has not inspired the relationship between levels of government. Without contesting the legal basis of regional ordinance, the essay focuses on the case of the Campania Region. The president of Campania has adopted several measures, that are more restrictive than those provided at the national level. These measures also raise some doubts of legitimacy. But the chapter shows that the decisions of the administrative judges have endorsed these more restrictive choices of the Region. The overall impression is pessimistic: the political dimension surpasses the juridical one in the emergency management and there’s no place for cooperation between levels of government.
