The new laws of the Return of Spain, Portugal and Austria: the Good of a profound reflection, against the «banality of evil»

Abstract

From 1st September 2020, a law passed last year by the Austrian parliament has allowed the descendants of Jews who fled the country due to the Nazi regime to obtain citizenship. This law is not new in the European panorama: already in 2015 Portugal first and Spain later amended their legislation to allow the descendants of the Sephardic minority to obtain an Iberian or Portuguese passport as «a final reconciliation with Sephardi communities». Considering the differences, the study analyzes in a comparative key the three Laws of Return which, in recognizing the discrimination that the Jewish people have had to suffer, recognize and try to remedy past persecutions.
