Critical analysis of the use of Family Constellations as a restorative practice in cases of violence against women

Abstract

In the face of the ineffectiveness of criminal policy to combat violence against women, the Brazilian National Council of Justice has recommended the implementation of Restorative Justice to address this problem. Due to its wide dissemination in the judiciary, Bert Hellinger’s Family Constellations technique has stood out under the label of restorative practice. Through a literature review, we verified whether this technique is compatible with the values of a decolonial Restorative Justice, or whether it reproduces the gender and race hierarchies still found in the substrate of gender violence, since the colonization process. With the same objective, we examine the bills related to the regulation of this technique and the “constellator» occupation in the Judiciary.
