Abstract

The recent ministerial decree of 11 April 2023, n. 161 places very stringent constraints on the publication of images of State cultural heritage. The application of the attached price list effectively considers any publication including Open Access to the payment of fees and the opening of a concession procedure which until now was resolved with a simple communication to the conservatory institutes. Starting from a concrete case, we illustrate the obstacles that the decree poses to the study and research on cultural heritage and the costs that this entails for researchers and for the public administration itself.
