Abstract
This essay illustrates the impact of ICT in the implementation of the constitutional right to health guaranteed by art. 32 of the Italian Constitution, focusing on three main issues: the balance between the right to health and the right to protection of digital health data, the right to be informed on the use of ICT in health care, the importance of State regulation so that digitization does not increase the gaps amongst Regional Health Services.
