The MiCAR Proposal and Unfair Terms: A First Analysis
Abstract
The essay focuses on the relationship between consumer contracts and criptoactivity. It questions whether cryptocurrency service providers, within the proposed Regulation MiCAR, are to be qualified as private authorities and the relevant contract is to be deemed as a device through which their powers sand autonomy become «transparent and claimable».
