Abstract

The article first highlights the intersubjective, subjective and objective character of the defining aspect of social rights, as well as their structural and functional dimension. Secondly, starting from the analysis of the meaning of the constitutionalisation of social rights, the article investigates the relationship between the latter and individual rights of freedom, revealing a fundamental incongruity between them that can only be assumed in a perspective of mutual transformation and fragile complementarity.
