Abstract

The study is focused on parental conflict in separation and divorce settlement, explaining as mediation would be able to represent a good solution to find the lost communication between the couple's members. The analysis, moving from the alternative dispute resolution methods, describes the law's rules context, distinguishing between the various types of mediation and the others alternative family's dispute solutions, in order to protect the children. The essay concludes by proposing the spread of the culture of mediation as a method of enhancing private autonomy, which is also practicable with public intervention, if directed to the parties' conciliation and not just to institutional control.
