Ex post assessment of compatibility related to the conservation of cultural property: technical discretion between questions of fact and questions of law
Abstract
The article discusses the assessment of compatibility with regard to historical-artistic constraints carried out by the authority in charge of the protection of cultural heritage once interventions have been carried out (ex post assessment).The article discusses the preconditions and the value of this evaluation on the administrative and criminal punishment foreseen for such abuses.
