Abstract

The Pavone’s essays on the continuity of the State between Fascism and the Republic contain a severe criticism of the formalism of jurists and a profound reflection on the criteria for defining a democratic State. In the view of Claudio Pavone, in fact, the examination of the democratic nature of the State must not stop at the structure of legislative power but must also invest the activity of the administration and jurisdiction.
