Abstract

The article intends to reconsider property and the related issues. After a short historical and comparative background (focused especially on the US experience), the author underlines the marginal role played by the individual property of the physical person, in comparison with the importance assumed by the property referred to public and private bodies. This evolution may be explained if the scholar, by changing the traditional approach, takes into account the plurality of the interest involved in the property rights, and the need for rules and principles able to govern and balance these various issues. This appears as a new research perspective, with the goal to put property again at the center of the system.
