Abstract

This work analyses some important developments in the EU’s jurisprudence on counterterrorism measures, building on Hamas and LTTE as relevant case-studies to shed light on the relations between the Council and the Court of Justice in this context. These cases offer the opportunity to reflect on the crucial role played by judicial review within the EU institutional system, ensuring compliance with European human rights standards and strengthening the narrative of the EU as a Union of law.
