Abstract

The draft agreement that the Veneto Region has submitted to the Government of the Republic as part of the negotiation initiated pursuant to Art. 116, third paragraph, of the Constitution, provides – among others – an strange legal provision which aims at «Strengthening the role of the Region in the control and management of migratory flows for economic reasons», in declared enactment of Art. 118, third paragraph, of the Constitution. According to the Region which proposes this provision, this law should contribute to anticipate the content of the future state law of differentiation, however such a legislation seems to be vitiated by constitutional illegitimacy: under multiple and concurrent profiles.
