Abstract

Regional legislation often deals with the provision of legal assistance to people who are injured in their rights or in case of weak people, guaranteeing them a protection varying, as the case may be, from legal aid to advice in a broad sense. Sometimes putting the task of intervening in this sense at the head of the regional apparatus, sometimes ensuring the benefit through the network of local bodies and/or private non-profit bodies. Moving from some isolated hypotheses, in which the regional advocacy was recognized in connection with legitimate defense, this paper aims at describing the general framework of such interventions, evaluating their compatibility with the criteria for the distribution of legislative powers between the State and the Regions, as stated by the Italian Constitution (art. 117, paragraph 2, lett. l).
