Abstract

The Author faces the subject of parental leave in the perspective of the European Union discipline. The implementation of the directive, which in turn contains the cadre agreement between the social parties, enters a complex frame of relationships between normative sources; national legislation is in fact, since a long time, settled on the facultative leave. The supposed over-protection of the national system collapses, in particular, when it is compared to the temporal extensoin to 8 years of life of the child and to the guarantee of an individual right of the working-father.
