Abstract

The Author analyses the effects of collective agreements on the provision of new criteria for the choice of redundant workers. He first describes the problems of legitimacy of collective agreements in the area of redundancies, and in particular he analyses the decision of the Constitutional Court n. 268 of 1994 on this issue. He finally takes into consideration a peculiar criterion introduced by collective agreements, that is that of the proximity to retirement of the worker to be made redundant.
