Abstract

The paper represents an assessment of employment's stability, in consideration of existing case law. For this purpose, after having reminded the ascendants of the debate regarding the freedom of dismissal, an attempt is made to illustrate how the contents of the right of reinstatement in employment, provided for by art. 18 of "statuto dei lavoratori", has been strongly downsized by judicial and doctrinal current interpretation. The paper ends with an illustration of the effects of a possible disappearance of stability from the horizon of labour law.
