Abstract

With the order n. 24/2017, the ICC lodged a preliminary reference to the CJEU concerning the interpretation of the Taricco decision (C-105/14). With this step, though with institutional fairness, the ICC shows a quite aggressive approach toward Luxembourg, while at the same time seeking to promote a more balanced relationship when basic constitutional choices are at stake.
