Abstract

This work reflects upon uses and functions of «Good Faith» and «Fairness» in Contract Law according to Stefano Rodotà's perspective, as it appears in his book "Le fonti di integrazione del contratto", Milan, 1969. Moreover, it examines how the Italian Case Law has followed Rodotà's teaching in the last decades. The impression is that - after years of «expansionism» about the rule of «Good Faith» and «Fairness» in Contract Law - a season of «restrictionism» has begun, due to some temporary reasons worthy of further study.
