Abstract

The essay analyzes the bill of the Superior Council of the Judiciary (CSM) elaborated by the Governmental Study Commission: the author observes how the bill is grafted into the political-constitutional context that connotes the link between political parties and magistrates’ associations. Compared to past, when the government and political parties tried to reduce the autonomy and independence of the judiciary, today it is the power of the magistrates’ associations that conditions political power and government decisions.
