Abstract

Silvia Salardi's work, "Discriminazioni, linguaggio e diritto. Profili teorico-giuridici. Dall'immigrazione agli sviluppi della tecno-scienza: uno sguardo al diritto e al suo ruolo nella società" (2015) represents an important contribution in the Italian debate on discrimination. Within a broader analysis, the issue of discrimination provides a «perspective to look at the relationship between law and power», as well as the role and functions of law in present western societies. The methodological approach used to guide the analysis is Uberto Scarpelli's view of «law as language», through which the author can make her own proposal of definition and her own discrimination typology. This perspective deals with the difficulties related to the effectiveness of fundamental rights and the involvement of collective and institutional subjects in the necessary cultural endeavour aiming at contrasting discriminatory acts and intents.
