Abstract

The transformations of the digital economy impose new challenges to the protection of antitrust, starting with the concept of market power as a competitive paradigm linked to the size of the company, so much so that it is believed by many that antitrust regulation does not have citizenship in the new digital asset – the A. –, starting from the consideration of the inadequacy of the traditional market models (reference on the meeting of supply and demand and relative price formation) with reference to the economies governed by algorithms, and called the attention of those who turn their attention to the dynamic aspect of the markets, in order to prevent the creation of excessively rigid barriers to entry, observe how the attention of regulators shifted from the voluntary nature of conduct to avoid that the search for every cost of a form of intentionality in anticompetitive conduct determines, ultimately, a vacuum to protect consumers’ damages.
