Abstract

The short essay critically comments on a decision by the Italian antitrust authority. It had been called upon to deal with a case in which, pursuant to Article 62 of Law 27 of 2013, the existence of a hypothesis of abuse of economic dependence put in place by a seed company against agricultural producers was denounced. The company used the contracts concerning the multiplication of seeds also for the final sale of the seeds so as to monopolize relations with food companies. In its decision, the Authority limited itself to applying only that rule, although the situation actually ascertained by the Authority itself had unequivocally highlighted that there was a much more serious episode of abuse of a dominant position perpetrated by this company to damage the entire agri-food chain.
