Abstract

In the context of the recent debate on right and its founding categories, the Author discusses the lessical and theoretical changes that bring us today to prefer the use of the concept of person instead that of agent. According to the Author, the concept of person, as it is used today in juridical theory, is a conceptual tool that gives us the chance to overcome abstract formalism of the juridical agent, as it has been used by giusnaturalism and by positivism
