Abstract

This article focuses on the relationship between torture and law. It offers an accurate analysis of the argumentative strategies related to the legitimacy of certain torture techniques. Starting from arguments and theories used to support it, the article criticizes the several attempts to legalize torture and to accept it as a legal instrument against terrorism. Finally, it clarifies the reasons why the prohibition of torture must be absolute and should represent the milestone of modern law.
