The United Nations Convention on the Rights of Persons with Disabilities in the Case Law of the European Court of Human Rights: Some Reflections on "Guberina v. Croatia"

Abstract

The Council of Europe has long provided protection for the rights of persons with disabilities, through both the European Social Charter and the European Convention of Human Rights. In this context, it is particularly remarkable the role of the innovative case law of the European Court of Hu-man Rights. After an overview of the most recent ECtHR disability case law, the article focuses on "Guberina v. Croatia". The judgment offers the opportunity to discuss the influence of the 2006 United Nations Convention on the Rights of Persons with Disabilities on the European Court of Human Rights case law, as well as its evolution and future prospects.
