Abstract

The paper analyses a recent judgement of the Grand Chamber of the European Court of Human Rights, issued on 15 December 2016 in the case "Khlaifia and Others v. Italy" (application no. 16483/12). The Grand Chamber partly quashed the judgement of the Chamber of 1 September 2015, founding that the Respondent State has not violated its obligations under Article 3 ECHR and Article 4 of Protocol No. 4 to the ECHR in relation to the detention and expulsion of three Tunisian citizens, who arrived on the Italian shores after the events surrounding the 'Arab Spring' in 2011.
