Abstract

The article analyses two main topics considered by the Court of Justice in the Fransson judgment. First of all, the scope of application of the Charter of fundamental rights of the EU is considered, namely as far as art. 51 of the Charter is concerned. Secondly, the paper analyses the field of application of the ne bis in idem principle, in case an administrative and a criminal sanctions are at stake.
